OSU MANTSE CAUTIONS TENANTS DEVELOPERS AND
BUSINESS OWNERS OVER OSU STOOL LANDS
It has come to the attention of Nii Nortey Owuo III Osu Mantse that while the Osu Chieftaincy dispute is being resolved in Court and at the Greater Accra Regional House of Chiefs, Dodowa, the usurper chief has been intimidating tenants on Osu Stool and other lands with threats of Court action. Indeed he has sued a good number of them for large sums of monies. The office of the Osu Mantse, Nii Nortey Owuo III is hereby asking all tenants to ignore the intimidation of the usurper chief, Nii Okwei Kinka Dowuona VI also known as Michael Dowuona-Owoo.
The Supreme Court of Ghana on 17 May 2006 see Re Osu Stool Ako Nortei II (Mankralo of Osu) v Nortey Owuo III (Intervener) (2005-2006) SCGLR 628; decided that the withdrawal of Government recognition under Local Government Bulletin 23 of August 1986 did not operate to destool Nii Nortey Owuo III as Osu Mantse. This judgment remains in force and has not been set aside or appealed against.
Nii Nortey Owuo III Osu Mantse would like to caution the general public, especially estate developers, private owners, tenants; those on Osu Stool properties which have already expired or about to expire; not to heed the call of the usurper chief to pay huge sums of money to atone tenancy. It is in the interest of the affected tenants and developers to wait until the various cases in Court challenging the capacity of the usurper chief are resolved. One needs not pay for the same property twice.
The two main cases currently in Court on these matters are:
- The Supreme Court of Ghana – Review appeal Civil Appeal No J7/9/2017.
- Suit No GARHC/P2/2014 challenging the capacity of Nii Okwei Kinka Dowuona VI also known as Michael Okwei Dowuona-Owoo as Osu Mantse.
Not being the Osu Mantse Nii Kinka Dowuona VI, had no capacity whatsoever to apply, as he did, to the National House of Chiefs to delete the name of Nii Nortey Owuo III as Osu Mantse from the National Register of Chiefs and to have his name inserted; thereby substituting himself in Nii’s stead as the Osu Mantse. Worse still, the unlawful substitution of his name for Nii Nortey Owuo III was ironically based on the void ground of destoolment by ‘withdrawal of Government recognition’ which the concurrent judgments of the Appeal Court on 18 February 2005, (2003 -2005) 1GLR 274, CA at 224 and the Supreme Court on 17 May 2006 had discredited.
All developers and businesses dealing with Nii Okwei Kinka Dowuona VI the self-styled Osu Mantse are taking undue risks and they are advised to hold off for the outcome of the challenge to the capacity of Nii Kinka Dowuona before the Judicial Committee of the Greater Accra Regional House of Chiefs, Dodowa and that of the Supreme Court; in order not to lose their investments.
Nii Nortey Owuo III further requests the Lands Commission to be very vigilant in executing its mandate, particularly in the registration of lands for the general public with particular reference to Osu Stool lands which include Osu Mantse layout, Ringway Estates, Ridge, Roman Ridge, North and South Dzorwulu, among others. Again, the Lands Commission is advised to stop processing documents submitted by Nii Okwei Kinka Dowuona VI as the Supreme Court judgment of 17 May 2006 in favour of Nii Nortey Owuo III remains in force.
Developers and tenants who are discerning must first submit their land acquisition documents to the Nii Nortey Owuo III’s led Council for validation before processing at Lands Commission; as currently, Nii Nortey Owuo III retains lawful possession of the Osu Black Stool, the symbol of his chiefly status as Osu Mantse.
Ghana is a free country but it is also a country governed by laws. Therefore, those who persist and fail to heed this soft warning do so at their own risk. Ultimately, the real ‘Osu Traditional Council’ will be forced to take action against those who are aiding and abetting the usurper chief.
